Under Ukrainian trademark law, applicants who reside or have their permanent location outside Ukraine may act before the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO) only through a registered Ukrainian representative. What you need to file in Ukraine

Power of attorney

A simply signed POA is sufficient. No notarisation and no legalisation are required. A scanned copy is accepted for filing.

Applicant details

Full name and address. Foreign companies also state their registration number in the country of incorporation; individuals state an identity document number.

The mark and the list

A representation of the mark and a list of goods and services under the Nice Classification. Multi-class applications are allowed; official fees depend on the number of classes.

Priority, if claimed

Convention priority within 6 months of the first filing; the certified priority document is due within 3 months of the Ukrainian filing date.

The language of the proceedings is Ukrainian. We prepare the specification in Ukrainian and, for word marks, advise whether a parallel filing in Cyrillic script is worth the extra class fees for your brand.

How the procedure runs

Availability searchIdentical and confusingly similar marks in the Ukrainian register and Madrid designations, with our legal opinion. 1–3 business days.
FilingElectronic filing with UANIPIO; the filing date is secured on the day the application is accepted. 1–2 business days from receipt of instructions.
Formal examinationThe Office checks the documents and the classification.
Substantive examinationAbsolute and relative grounds. Office actions are answered within the term set by the Office; we prepare the arguments and report to you before filing.
RegistrationPublication and issue of the certificate after the final fees are paid.
Overall timingRoughly 18–20 months where no office action or opposition arises. Accelerated examination is available at an additional official fee.

A Ukrainian registration lasts 10 years from the filing date and is renewable for further 10-year terms. We docket the renewals and remind you in advance.

Professional fees are fixed in euro. Official fees are set in Ukrainian hryvnia and shown converted at the current NBU rate, so the amount payable may vary slightly with the exchange rate. The state duty for foreign applicants is fixed in US dollars by Ukrainian law. Responses to office actions, oppositions and appeals are quoted separately before any work starts.
